  • 1. Contest Period: The Win a Shoto (“Contest”) begins at 12:00:00 AM Eastern Time September 1, 2007 and ends at 11:59:59 PM ET July 1, 2008.
  • 2. “Customer” Defined: A Bonika customer is defined as a stylist or other professional in the hair industry who has become a Bonika Shears owner and has agreed to the terms and conditions of the contest. They may have become the owner through purchasing, gifting, winning or other legal acquisition of a Bonika Shear. The shear is to be a Bonika manufactured shear and not another brand that may be sold by Bonika or their distributors. Pre-owned or “Mystery Shears” are ineligible. those wishing to participate that are not a part of the above criterior may do so by email request to sales@bonika.com. They are to state that they would like to participate in the win a shoto contest. Please send your name, address, phone number, email. You will then be entered in the contest without having made a purchase. These requests must be made by June 1, 2008 for processing. One request per person and one request per address.
  • 3. How to Win: a. At 12:00:00 AM Eastern Time September 1, 2007, the start of the Contest Period, all “Customers” who acquire a Bonika Shear from this time until the end of the contest will be registered through the official entry form supplied directly by Bonika Shears or a distributor. It is the responsibility of the customer to see that the form is returned to Bonika Shears. The form does not have to be filled out in full, but the shear purchased, owner’s name, city state and salesman’s name must be present. If they do not include the mailing address, they must confirm that their salesman has this information. If a customer does not receive an entry form by oversight by Bonika Shears or their distributor, they may notify Bonika Shears and receive an order form.
  • 4. Determining Winners: By participating, contest participants hereby agree that the official drawing at the Sharpener’s Jam in July 2008 will determine the winner and the witnesses at that event shall be the determining factor in the event of any dispute. Also, the winner must agree to furnish their photo in order to be featured on the Bonika Shears website and on any literature their salesman may use to promote sales of Bonika Shears.
  • 5. Disqualification: Contestants will be disqualified from the Contest if they fail to comply with these Official Rules.
  • 6. Prize: An official Grand Prize of a Bonika Shoto shear will be awarded to the winner. It will be delivered in person or through FedEx after received of a photo of the winner and verification of eligibility. 3 more names will be drawn in case the winner should prove ineligible. The length of the Shoto will be at the discretion of the winner based on the sizes in stock at the time. An additional Shoto shear may be awarded to the salesman who sold the shear if either they or their business partner are present at the time of the drawing. This Shoto awarded to the salesman will be the length based on the selection of Bonika Shears.
  • 7. In the Event the Salesman is a Bonika Shear Employee: If the salesman with the winning name is a Bonika Shear employee they may be awarded a bonus based on the profits of the Shoto Shear when sold at sale price. A website winner will be deemed a sale by the top office employees and the bonus divided accordingly.
  • 8. Winner Notification: a. Administrator will notify the winning Affiliates by mail and/or e-mail on or about August 1, 2008. b. Winners will be required to sign an Affidavit of Eligibility, which must be properly executed and returned within ten (10) days of issuance or the prize will be forfeited and awarded to an alternate winner. The winner must also send a photo of themselves to be used in any manner of self promotion that Bonika Shears sees fit that would not cause embarrassment or unneeded invasion of privacy. c. The winner is responsible for payment of all taxes and/or fees on the prize and for any other expenses not specifically described herein. d. If the prize or prize notification is unclaimed or returned as undeliverable, or if a winner fails to properly sign and return all forms described herein, the prize will be forfeited and awarded to an alternate winner. e. By participating in the Contest, entrants hereby grant Sponsor all rights, including the right to edit, publish, use, adapt, modify, or dispose of any proper names, likenesses, photographs, and/or city/states without further consideration or payment to the entrant online (including on the Bonika Shears Site), in print, or in any other media (including the Internet) for advertising and promotional purposes for this and similar promotions, without additional compensation, except where prohibited by law. f. If an entrant changes his/her telephone number, e-mail address and/or street address after he/she enters the Contest, it is his/her sole responsibility to notify the Sponsor by (postal) mailing notice to the Contest Administrator address (listed below) to be received by the end of the Contest Period.
  • 9. Eligibility: a. Contest is open only to customers who have attained a Bonika Shear during the eligibility time. Relatives of distributors are eligible, but they must show additional proof that they have received and personally utilize the Bonika Shears. b. Employees of Bonika Shears and all distributors and their immediate families (spouse, parents, children living at home) and individuals living in the same household as such employees are ineligible to participate as a customer. However, any of these individuals are eligible to win based on the presence at the drawing and their name listed as a salesman on the official winning entry form. c. Void where prohibited by law. This Contest is subject to all applicable federal, state, and local laws and regulations.
  • 10. LIMITATION OF LIABILITY: BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE TO ABIDE BY THE TERMS OF THESE OFFICIAL, WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THE RULES, AND RELEASE, INDEMNIFY AND HOLD HARMLESS THE SPONSOR, ITS AFFILIATES, SUBSIDIARIES, DISTRIBUTORS, SALES STAFF, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE AGENTS, REPRESENTATIVES, OFFICERS, DIRECTORS AND EMPLOYEES (COLLECTIVELY, “RELEASEES”) FROM AND AGAINST ANY INJURIES, LOSSES, DAMAGES, CLAIMS, ACTIONS, OR ANY LIABILITY OF ANY KIND RESULTING FROM OR ARISING FROM PARTICIPATION IN THE CONTEST (INCLUDING BUT NOT LIMITED TO ANY USE, MISUSE, OR NONUSE OF THE PRIZE BY THE WINNER), OR ACCEPTANCE, POSSESSION, USE, MISUSE OR NONUSE OF THE PRIZE THAT MAY BE AWARDED. WINNERS AGREE TO ACCEPT THE PRIZE “AS IS”. BONIKA SHEARS MAKES NO REPRESENTATION OR WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE PRIZE.
  • 11. Additional Terms and Conditions: a. Entrants agree that any and all disputes relating to the Contest shall be governed by the laws of the State of Georgia. b. Bonika Shears is not responsible for printing or typographical errors in any Contest related materials; or for entry forms that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including, mail system, human or other error; or for inability to access any Web site associated with this Contest, or process any transaction thereon. c. If in the Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the Contest, or if unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and/or void any entries submitted fraudulently, modify or suspend the Contest, or to terminate the Contest and prize as a result of the action requiring such termination. d. Sponsor reserves the right to modify or terminate the Contest in its entirety at any time and at its sole discretion. e. Should the Contest be terminated/modified prior to the stated end date, notice will be e-mailed to the participating participants. f. Any attempt by an entrant to undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, the Bonika Shears reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
